By using our website (bynouck.com), placing an order, or visiting our physical store, you agree to be bound by these Terms and Conditions (“T&Cs”). These T&Cs, together with our Privacy Policy and any additional guidelines published on our website, govern your relationship with ByNouck Jewelry (“ByNouck”, “we”, “us”, or “our”). In cases where EU law provides mandatory consumer rights, those rights prevail.

These T&Cs apply to all transactions, deliveries, offers, orders, and agreements made via our website and in our brandstore. By placing an order, you confirm that you have read, understood, and agree to these conditions.
We reserve the right to amend these T&Cs at any time. The version in effect at the time of your order placement will apply. We encourage you to review our T&Cs periodically.
These T&Cs are governed by Dutch law. Notwithstanding the foregoing, your statutory rights as a consumer under EU law remain unaffected.

• Placing an Order:
When you place an order by clicking the “Place Order” button, you confirm your acceptance of these T&Cs. A confirmation email with an order number will be sent to you. (If you do not receive this email, please note that your order is still valid.)
• Minimum Order Amount:
The minimum order amount is €15 per delivery.
• Price Information:
All prices are quoted in euros and include 21% VAT. Prices are subject to change at any time and such changes will not affect orders already placed.
• Offers and Typographical Errors:
Offers displayed on our website are valid only for the current transaction and are not automatically applicable to repeat orders. In the event of a typographical error, we reserve the right to correct the offer without liability.
We offer a range of payment methods for your convenience. All available payment options are displayed during the checkout process. By placing an order, you agree to pay the full amount as indicated at the time of purchase.
• Usage:
Gift cards can be used as a payment method toward orders placed via our website or at our brandstore. To redeem a gift card, enter the unique code provided during checkout in the designated Gift Card field.
• Conditions:
• Gift cards cannot be purchased using a discount code.
• You may apply a maximum of one gift card and one discount code per transaction.
• Gift cards have no cash value and cannot be redeemed for cash.
• A gift card is valid for 2 years from the date of issue.
• Gift cards cannot be used to purchase contact money.
• Delivery to Mailboxes:
Orders may be delivered to a mailbox provided that it meets PostNL’s requirements. The slot must have a free opening of at least 265 mm in length and 33 mm in width. If there is an internal compartment behind the slot, its minimum dimensions should be 270 mm (W) x 150 mm (H) x 380 mm (D).
• Multiple Packages:
To ensure successful delivery, your order may be split into multiple packages. If your mailbox is full or does not meet the required specifications, your order may be redirected to a designated pick-up point or returned to us.
• Tracking:
You will receive tracking details for your order. Please monitor these details to stay informed about your delivery status.
• Eligibility and Exclusions:
Discount codes are offered as part of promotional campaigns and may be subject to specific eligibility criteria. Discount codes are not applicable on our new collections or on the following items: gift wrapping, extra gift pouch, collection box, gift box, gift cards, sample sale products and Fill the Box.
• Usage Limitations:
Typically, each discount code may be used once per customer or per transaction unless stated otherwise. Discount codes are non-transferable and cannot be combined with other promotions unless explicitly noted.
• Redemption and Limitations:
To use a discount code, enter it during the checkout process exactly as shown (codes are case-sensitive). Discount codes have no retroactive effect on previous purchases and hold no cash value.
• Right of Withdrawal (Cooling-Off Period):
For non-personalized jewelry, you have the right to cancel your purchase within 14 days from the day of delivery. The item must be returned in its original condition at your own expense. Please refer to our Return Process for detailed instructions.
• Non-Returnable Items:
• Earrings, bracelets, rings, and necklaces that have been worn cannot be returned for hygienic reasons.
• All engraved or personalized jewelry is not eligible for return unless there is a production error. In the event of a production mistake, please contact our Customer Support for a mutually acceptable solution.
• Warranty:
We provide a 6-month warranty from the date of purchase for production defects. After this period, it may not be possible to distinguish between damage caused by a defect and that caused by normal wear and tear. This warranty is in addition to your statutory rights under EU law.
• Return Shipping and Liability:
We are not responsible for items lost or stolen during return shipment. We recommend using a trackable shipping service or other proof of postage when returning items.
• Use of Images:
All images and photographs on bynouck.com are protected by copyright. No reproduction, redistribution, or publication is permitted without our prior written consent. Unauthorized use of our images may result in legal action.
• Liability Cap:
Our liability for any direct or indirect damages arising from the use or delivery of our products is limited to an amount equal to the selling price of the product in question, except where such limitation is prohibited by mandatory law.
• Exclusions:
This limitation does not affect your statutory rights as a consumer under EU law.
If ByNouck is unable to fulfill its obligations due to events beyond its reasonable control (including, but not limited to, natural disasters, labor disputes, or government restrictions), the performance of those obligations will be suspended for the duration of the force majeure event. If such an event persists for more than 30 days, either party may terminate the agreement without liability for compensation.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data in compliance with the General Data Protection Regulation (GDPR) and other applicable EU data protection laws.
We love to see our jewelry styled in your own unique way! When you share photos or videos of our products and use the hashtag #YesByNouck on social media, you agree to the following:
• License Grant:
You grant ByNouck a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable license to use, reproduce, modify, adapt, publish, and display your content (including images, videos, captions, etc.) across our marketing channels, including our website, social media, email campaigns, advertisements, and in-store displays.
• Content Ownership and Rights:
You confirm that you own all rights to the content you provide and that it does not infringe on any third-party rights (e.g., copyrights, trademarks, privacy, or publicity rights).
• No Compensation:
You acknowledge that ByNouck will not provide any monetary compensation for the use of your content.
• Revocation:
If you wish to revoke this permission, please contact us at info@bynouck.com. While we will make reasonable efforts to remove your content from future materials, we cannot guarantee the removal of content that has already been published or distributed.
• Severability:
If any provision of these T&Cs is found to be invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.
• Entire Agreement:
These T&Cs, together with any referenced documents, constitute the entire agreement between you and ByNouck regarding your purchase and use of our products.
